These Terms & Conditions (“Terms”) govern the access to and use of the website www.findbeststay.com and all services, tools, communications, and booking-related assistance offered thereon (“Website”, “Service”). Find Best Stay is owned and operated by ATW STAYS (OPC) Private Limited, a company incorporated under the laws of India (“Company”, “we”, “us”, “our”).
These Terms apply equally to individual customers, families, groups, corporate travelers, companies, travel managers, B2B agents, and institutional clients who access or use the Website or Services, whether for personal, business, or commercial purposes.
1. Acceptance of Terms
By accessing the Website, submitting any hotel pricing information or screenshots, requesting a price verification, opting for a booking, making any payment (including advance or hold payments), or otherwise using the Services, you expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions, along with our Privacy Policy and Refund Policy.
If you do not agree to any provision of these Terms, you must immediately stop using the Website and Services. Continued usage shall constitute unconditional acceptance of all applicable terms.
2. Nature and Scope of Service
Find Best Stay operates as a hotel price assurance, verification, and booking facilitation platform. Our Service is designed to assist customers, families, corporates, and B2B clients in identifying potentially better hotel pricing by verifying publicly available rates and, where feasible, sourcing alternative or negotiated offers through our supplier and partner network.
Find Best Stay does not own, operate, manage, or control any hotel, accommodation provider, or hospitality service. We act solely as an intermediary facilitator. All hotel services, amenities, policies, and obligations remain the sole responsibility of the respective hotel or supplier.
3. Eligibility & Permitted Users
The Services are available to individuals, families, group travelers, corporate organizations, companies, B2B travel agents, tour operators, and institutional clients. There is no restriction on commercial or non-commercial usage, provided that all information submitted is accurate, lawful, and compliant with these Terms.
B2B agents and corporate users acknowledge that they are responsible for ensuring that any end customer or traveler on whose behalf a booking is made is informed of and agrees to the applicable hotel policies, cancellation rules, and refund terms.
4. Consent to Communication
By providing your contact details, including mobile number, WhatsApp number, and email address, you expressly authorize Find Best Stay to contact you for service-related purposes. This includes, but is not limited to, verification of submitted details, booking confirmations, payment coordination, service updates, and post-booking communication.
Standard telecom or data charges may apply. Opting out of essential service communication may restrict our ability to process or complete your request, and Find Best Stay shall not be responsible for any service impact arising thereof.
5. Deal Submission, Verification & Comparison
All pricing submissions, screenshots, URLs, or booking details provided to Find Best Stay must be genuine, current, unaltered, and sourced from legitimate publicly accessible B2C hotel booking platforms. Any form of manipulation, misrepresentation, or outdated pricing may result in outright rejection.
Comparisons are conducted strictly on an “apple-to-apple” basis, meaning that hotel name, room category, dates, occupancy, inclusions, taxes, and cancellation policies must be identical. Any discrepancy may invalidate the submission.
Corporate contracts, B2B-only portals, private negotiated rates, loyalty rewards, bank offers, coupon-based discounts, or employee-only benefits are excluded from comparison and verification.
6. Price Improvement Disclaimer
While Find Best Stay endeavors to secure improved pricing where possible, price enhancement is not guaranteed. All offers are subject to supplier availability, inventory conditions, and operational feasibility at the time of confirmation.
7. ₹499 Booking Hold Facility
Find Best Stay may offer an optional ₹499 booking hold facility that temporarily blocks a rate or inventory until a communicated payment deadline. This amount is charged towards administrative processing, rate protection, and supplier blocking.
The hold amount is strictly non-refundable under all circumstances. If full payment is completed within the specified cut-off time, the amount may be adjusted against the final booking value. Failure to complete payment within the deadline will result in forfeiture without exception.
8. User Responsibility & Booking Accuracy
The customer, corporate entity, or B2B agent is solely responsible for ensuring that all booking details—including guest names, dates, room type, and occupancy— are accurate and final before confirmation.
Once a booking is confirmed, especially if classified as non-refundable or within a cancellation penalty window, Find Best Stay shall not be liable for any losses arising from incorrect information, change requests, or hotel policy enforcement.
9. Dynamic Pricing, Availability & Refunds
Hotel pricing and availability are dynamic and may change without notice. If a payment is made but the booking cannot be confirmed due to price or inventory changes beyond our control, the customer shall be eligible for a full refund of the amount paid.
No additional compensation, damages, or claims shall be applicable in such cases.
10. Limitation of Liability
Find Best Stay shall not be liable for hotel service quality, supplier failures, technical delays, communication lapses, or indirect or consequential losses. Any liability, if established, shall be strictly limited to the amount paid for the relevant booking.
11. Right to Refuse or Discontinue Service
Find Best Stay reserves the right to refuse, suspend, or terminate service without notice if a user is found to be fraudulent, abusive, misleading, or acting in violation of these Terms.
12. Privacy & Data Protection
All personal and business data is processed strictly in accordance with our Privacy Policy and applicable data protection laws.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Continued use of the Website or Services after updates constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.
